How We Work
1. Complete Information Form
Fill in some details about your business and your trademark.
2. We Search Your Trademark
We will review your information, contact you as necessary, and conduct a comprehensive U.S. trademark search for your proposed mark. We will send you a report and communicate our analysis of the results within five business days.
3. We Draft and Submit Your Application (Search and File Package Only)
If you purchased the "Search and File" package, we will work with you to prepare a new U.S. trademark application. Once you review and sign the completed application, we'll submit it to the U.S. Patent and Trademark Office ("USPTO") and send you a filing report.
After your application is reviewed by the USPTO (which currently takes several months), we will report the communication from the USPTO and advise you of next steps and estimated costs.

Frequently Asked Questions
Why shouldn’t I use a cheaper service?
In legal work, more than in any other case, you get what you pay for. There are a myriad of filing and quasi-legal services out there happy to part you from your money with the lure of a low sticker price. In almost all cases, what you’re getting is not value, but a future of headaches and likely a trademark application or registration that does not adequately or appropriately protect your business. We often help clients rescue trademarks from such discount filing services and typically the “savings” of such ...
Are there costs beyond what I’m paying for now?
YES. This is very important, and something often not made clear by other filing or quasi-legal service providers. What you’re paying for through this TMApplication.com website is initial work required to clear your trademark, and if selected, to also prepare and file the trademark application at the USPTO. These steps are only the beginning of the process of registering your trademark. The USPTO examination and approval process has several steps (including possible objections and requests...
Why can’t I choose a “File Only” option?
Both of our packages offer searches because we believe it is a vital part of the trademark application process. Not only does it provide some insight on whether your application may be acceptable and successful at the USPTO, but it also may provide you with information on the strength of your mark, how other people may be using the same or similar marks in the marketplace, and some guidance on any limitations to your use of your mark going forward. The comprehensive search provides you with this valuable business information...
